gsmobilestore Services Terms of Use
This agreement governs your relationship with gsmobilestore Digital Services LLC (referred to as “gsmobilestore” or “we” and its affiliates). Before using the gsmobilestore Services on a Product, please carefully read these gsmobilestore Services Terms of Use, along with the applicable rules, policies, and terms available at the gsmobilestore.com website or through the gsmobilestore Software (collectively known as this “Agreement”). By using the gsmobilestore Services, you agree to abide by the terms of this Agreement. If you do not agree with these terms, you must refrain from using the gsmobilestore Services and adhere to the applicable return policy to return your Product. Your use of any gsmobilestore Service is contingent upon compliance with additional rules, policies, and terms specific to those services.
For the purposes of these gsmobilestore Services Terms of Use:
- Definitions:
- gsmobilestore “Services” refers to the provision of gsmobilestore Software, Digital Content, and support and other services provided to Product users.
- gsmobilestore “Software” encompasses all software made available for use on a Product, excluding third-party Digital Content.
- “Digital Content” includes digitized content (including third-party content) such as videos, music, apps, games, skills, photos, audio, books, newspapers, magazines, and related features and functionality.
- “Product” denotes a Fire TV Edition device developed and manufactured by a third party, allowing access to gsmobilestore Services.
- gsmobilestore Services, gsmobilestore Software:
- a. Use of gsmobilestore Services on a Product: To utilize specific gsmobilestore Services on a Product, you must possess your own gsmobilestore.com account, be logged in to your account on the Product, and have a valid payment method associated with your account.
- b. Use of gsmobilestore Software: You may use the gsmobilestore Software solely on your Product, except as provided in this section. Additional terms for the gsmobilestore Software can be found in the Additional gsmobilestore Software Terms within the gsmobilestore and the Legal section of the Settings menu of the gsmobilestore Services on your Product or the gsmobilestore Fire TV Remote App. gsmobilestore Software licensed under an open-source license is governed solely by the terms of that open-source license.
- c. Voice Services: Your Product may feature Alexa voice services, allowing you to perform tasks like controlling your Product, conducting searches, checking the weather, or operating other connected products. When using voice services, we process your voice input and other information in the cloud to respond to your requests and enhance your experience. Your use of Alexa is subject to the Alexa Terms of Use (www.gsmobilestore.com).
- Connectivity and Availability:
- a. Internet Connectivity: Some gsmobilestore Services may necessitate an Internet connection from a third-party provider to access certain features, subject to the provider’s fees, restrictions, terms, and limitations.
- b. Availability: Certain gsmobilestore Services may be unavailable, vary by product or geography, be offered for a limited time, or require separate subscriptions.
- General:
- a. Information Received: The gsmobilestore Software may provide information about your Product, Product usage, Digital Content usage, and gsmobilestore Services (e.g., search queries, installed applications, viewing and usage data, memory availability, log files, network diagnostics, voice information, and connectivity). Manufacturers of your Product may also provide similar information. Information processed in the cloud to enhance your experience and services may be stored on servers outside your country. Opt-out options are available in the Settings menu of your Product.
- b. Information Provided to Others: You are responsible for information provided to others, including third-party Digital Content providers. Use of such information will be subject to any privacy notice or other terms they provide.
- c. Changes to gsmobilestore Services; Amendments: We may change, suspend, or discontinue gsmobilestore Services or any part of them without notice. Amendments to this Agreement will be posted on the gsmobilestore.com website. Continued use of gsmobilestore Services after the revised Agreement’s effective date constitutes acceptance of the terms.
- d. Termination: Your rights under this Agreement will automatically terminate without notice if you fail to comply with its terms. In such cases, gsmobilestore may immediately revoke your access to gsmobilestore Services. Failure to insist on strict compliance does not constitute a waiver of any rights.
- e. Disputes/Binding Arbitration: Any dispute arising from or relating to this Agreement, a Product, the gsmobilestore Software, or gsmobilestore Services is subject to binding arbitration, as outlined in the governing law, disclaimer of warranties, limitation of liability, and other terms in the Agreement. You agree to these terms by entering into this Agreement or using a Product or gsmobilestore Services.
- f. Disclaimer of Warranties and Limitation of Liability: Products are developed by third parties, and we assume no responsibility or liability for any aspect except the gsmobilestore Services. Subject to applicable law, our aggregate liability and that of our licensors with respect to any claim arising from or related to this Agreement or your use of gsmobilestore Services will not exceed fifty dollars ($50.00).
